1. GENERAL CONDITIONS OF USE

1.1 Site Owner

The QUOTABOARD site is owned, managed and maintained by the Australian Fisheries Management Authority (AFMA).

AFMA reserves the right to determine what information is displayed on this site and will at its sole discretion remove any information which it considers breaches these conditions, is in any way whatsoever offensive or does not comply with any relevant laws.

AFMA reserves the right to canvas feedback from any Users of the site to assist in the improvement and further development of the site.

1.2 Purpose of QUOTABOARD

QUOTABOARD is a free website that enables any person to browse for Commonwealth quota, Statutory Fishing Rights (SFRs) and/or permits to buy, lease or for sale. Registered users are also able to advertise Commonwealth quota, SFRs and/or permits to buy, lease or sell.

The site is not to be used for advertising any other item and is NOT to be used for information gathering or survey purposes.

1.3 Conditions

These conditions are an agreement between you (you; or the user; or the advertiser; including operators and brokers) and AFMA.

When you agree to the Terms and Conditions at the time of registration on the web site, or prior to entering the site, you will be taken to have accepted these conditions and that you have agreed to comply with the requirements contained in these conditions. So please ensure that you have read and understood the terms and conditions before proceeding further.

1.4 Compliance with Laws

It is the users responsibility to ensure that any actions taken by the user in using QUOTABOARD comply with Commonwealth, State and Territory law.

If AFMA considers that any advertisement is in breach of any law, it will at its sole discretion immediately remove the advertisement.

1.5 AFMA’s Copyright

The copyright in material contained on QUOTABOARD that has been made by, or under the direction or control of AFMA, is vested in AFMA and no unauthorised use is permitted without express prior written permission.

Such material is provided only for non-commercial use by individuals or organisations.

1.6 Third Party Copyright

The copyright in other material contained in QUOTABOARD will generally have vested in the author. Accordingly, users must seek the permission of the copyright owners before using any such material.

1.7 Disclaimer

By material being placed on QUOTABOARD AFMA does not hold itself out as providing professional advice.

AFMA does not guarantee the accuracy or reliability of any of the material placed on QUOTABOARD.

2. ADVERTISER CONDITIONS OF USE

2.1 Advertisers Code of Conduct

Advertisers must:

  • Avoid any practice or activity that could reasonably be foreseen to bring QUOTABOARD into disrepute
  • Comply with all relevant Australian laws, including for example, privacy, fair trading, trade practices and anti-discrimination laws
  • Not breach anti-discrimination legislation by, for example, discriminating on the basis of an advertisement respondents race, age, gender, religion, sexual preference or other information that is not relevant to the advertised
  • NOT use QUOTABOARD to gather personal details for other databases

2.2 Applicability of Legislation

You should seek your own legal advice regarding the applicability of legislation. In particular you should note the provisions of sections 52, 59, and 51AB of the Trade Practices Act, may apply to your activities.

2.3 Monitoring and Removal of Advertisements

The information contained on this site resides on a computer system funded by AFMA. AFMA reserves the right to refuse access to this service.

AFMA reserves the right to assess all advertisements and website addresses listed within advertisements and withhold those it believes do not comply with these Conditions.

Information that is considered false, misleading, offensive or unlawful will not be displayed and will subsequently be removed from the system at AFMA’s sole discretion. The user responsible may be refused future access to this service at AFMA’s sole discretion and the matter may be referred to the appropriate authority.

QUOTABOARD is monitored on an ongoing basis to ensure currency and compliance with these Conditions. Where possible breaches are found, or where complaints are received about a job advertisement the advertisement in question may be withdrawn and access to QUOTABOARD by the originating user withheld during investigation. Where breaches of these Conditions are confirmed, access to QUOTABOARD may be denied to the users responsible. Serious breaches will be referred to appropriate agencies.

By using the site you expressly consent to monitoring by a computer system or AFMA or Commonwealth personnel including its servants and agents. Monitoring will include recording of a domain name server address and the pages viewed. Information will also be recorded where users have requested access to a secure portion of the site, have sent a message or submitted a form. The user must not place material on QUOTABOARD that is offensive or is misleading.

3. BUSINESS RULES

3.1 Advertisement Requirements

Users must ensure that advertisement they lodge on QUOTABOARD provide a clear and accurate description of the item to buy, for sale or for lease.

3.2 Unacceptable Advertisements

AFMA reserves the right to classify any advertisement as unacceptable for display on QUOTABOARD including those that could bring QUOTABOARD into disrepute. Examples of such advertisements are:

  • Advertisements which contravene Commonwealth and/or State/Territory legislation
  • Advertisements which contravene these Conditions of Use and Business Rules
  • Advertisements which involve activities, products or services which may be considered offensive, illegal or misleading
  • Advertisements involving any form of nudity or work in the sex industry
  • Pyramid selling schemes
  • Advertisements which do not provide full details of the offer to buy, sell or lease
  • Advertisements which require promotion of gambling or gambling websites
  • Advertisements which do not clearly specify any costs to be incurred by the prospective respondent
  • Advertisements not related to buying, selling or leasing of Commonwealth quota, SFRs or permits

3.3 Expiry of Advertisements

Advertisers must set an expiry date for all advertisements published to QUOTABOARD. The maximum period for an advertisement to remain on display is 60 days, unless modified in that period.

4. BROWSERS CONDITIONS OF USE

4.1 How does the QUOTABOARD site work?

The site allows users to search for advertisements and to apply for email notification of new advertisements as they are published to the site.

If you choose to receive email notification you are agreeing to receive notification (by email) from QUOTABOARD relating to advertisements and the use of the site.

4.2 Privacy

No personal details will be provided by the QUOTABOARD system unless you choose to include them. Your identity will remain anonymous. The QUOTABOARD site will not provide advertisers with the identity of users who have accessed their advertisements unless you send a direct response to their ad.
